New procedure for the communication of employee resignation and agreed termination

On November 11th 2016 it was published in the Italian Official Journal, largely later than the set deadline, the ministerial decree on the new communication procedure for an employee resignation or an agreed termination.

What was initially considered a simplification may, if not properly used, turn into a further and heavier bureaucratic commitment.

The worker who intends to resign will be required to communicate it to the employer via form provided by the Labour Ministry (available on www.lavoro.gov.it). The form, once filled, has to be sent by the employer via certified mail to the DTL (Labour territorial office).

In order to enter the form the worker must be in possession of a password code (PIN) provided by INPS, and then, register on the web portal (www.cliclavoro.gov.it). Alternatively, the worker can address certified subjects, such as: trade unions, bilateral agencies.

Through the same procedure the worker can exercise his revocation right no later than 7 days from the first communication date.

The full workability will come into force on March 12th 2016.
